Know your rights as an immigrant if stopped by law enforcement

U.S. Immigration and Customs Enforcement (ICE) agents are carrying out deportations across the United States on the orders of the current administration. At the same time, legal battles are occurring to protect the immigrants who are living and working in this country.

Immigrants have rights granted to them under the law. Knowing what they are is crucial if you find yourself dealing with ICE agents or any law enforcement officers.

The right to remain silent

If the police or ICE agents stop you, you are required to state your name. You are also required to show your immigration documentation to an ICE agent or any other immigration official. If you are operating a vehicle, you must also show your license, proof of insurance and vehicle registration. Besides that, you do not have to answer any questions, including your immigration status, where you were born and how you arrived in this country.

The right to counsel

You have the right to legal representation. If you are arrested or detained, assert that right immediately. You don’t need to provide any explanations and should continue using your right to remain silent until your lawyer arrives. You also have the right to contact your consulate. They can help you communicate with your family or address other immediate issues.

Freedom from searches

The police may pat you down to see if you are carrying a weapon. However, you don’t have to consent to a search of your home, body or belongings unless they have a warrant.

It’s understandable that you may feel scared, but it’s important to remain calm and polite. You should also memorize important phone numbers, such as those of close family members who can get you experienced legal guidance.
